General Terms and Agreement

Huswell BV exclusively supports clients in managing short-term rentals for furnished properties. This agreement outlines all terms applicable to both the client and any involved third parties. Huswell is committed to providing professional property management services with a focus on client satisfaction. However, it is important to note that Huswell operates on the basis of a means-based commitment (Dutch: "middelenverbintenis"), meaning Huswell will act with due diligence but cannot be held responsible for outcomes beyond its control.

Duration and Termination

The agreement has no fixed end date, providing flexibility with a three-month notice period for termination by either party, unless otherwise stated. In the case of false or misleading information, Huswell reserves the right to terminate the agreement immediately.

Third Parties and Liability

Huswell partners with carefully selected third-party providers (e.g., cleaners, maintenance staff) to ensure high-quality service. In rare cases of negligence by a third party, Huswell will assist with claims for damages where applicable. Liability is limited to direct losses; potential lost profits cannot be considered as direct losses due to the uncertain nature of the market. Huswell’s responsibility is limited to the efforts made to engage reliable third parties and manage relationships, but it cannot guarantee outcomes related to these external partners.

Client Responsibilities

To ensure smooth operations and compliance, clients are expected to adhere to the following guidelines:

  • Legal Compliance: Ensure compliance with local laws, including zoning, licensing, and tax obligations for short-term rentals.
  • Safety Measures: Ensure proper installation of safety equipment, such as smoke and carbon monoxide detectors, to meet legal and regulatory standards.
  • Essential Amenities: Provide essential guest amenities such as toilet paper, soap, linens, and sufficient bedding (at least one towel and pillow per guest).
  • Accurate Listing Information: Ensure the property’s listing is truthful and complete, including accurate photos, descriptions, and amenities.
  • Cleanliness: Maintain high cleanliness standards that meet or exceed Airbnb guidelines to ensure safety and guest satisfaction.

Huswell acts as an online management partner, helping streamline operations while ensuring the property remains under the ownership and responsibility of the client. Clients are expected to maintain appropriate property and liability insurance and uphold platform standards for their listings. While Huswell provides the necessary tools and support, clients must remain actively involved in maintaining compliance and quality.

Financial and Payment Details

Huswell manages guest payments on your behalf, deducting service fees and providing monthly statements detailing revenue and expenses. Annual adjustments to fees may apply, ensuring transparent financial management. Costs will be adjusted to reflect operational changes or market conditions.

Repairs, Privacy, and Updates

Huswell may handle necessary repairs to maintain the property’s rental standards. In the event that costs exceed €250, clients will be informed in advance. While repairs are not part of standard services, this provision ensures that urgent repairs required to preserve the property’s value and safety are handled promptly. The costs for these repairs are typically the owner’s responsibility. Huswell also ensures compliance with EU privacy regulations when handling personal data and will provide advance notice of any updates to the terms and conditions.

Legal Framework

This agreement is governed by Belgian law, and both parties aim to resolve any disputes amicably before considering legal action. This framework ensures fair treatment of both parties and supports the resolution of potential conflicts through cooperative means, in line with Huswell's commitment to acting with care and diligence.
